Prepaid funeral disclosure

Last updated 9 September 2026Template — obtain legal review before launch

Prepaid funerals in New South Wales are regulated by the Funeral Funds Act 1979 (NSW). This page summarises how your money is protected. The full terms are in the prepaid contract you sign, which prevails over this summary.

Where your money goes

Every dollar you pay is placed with an independent, government- registered funeral fund. We cannot spend it, borrow against it or access it. It is released to us only after the funeral you paid for has been delivered.

What is locked in

The services and items listed in your contract are provided when the time comes with nothing more to pay — however many years pass and however prices rise. Items a third party controls (for example a specific cemetery’s fees) are shown either as included at a capped amount or as an estimate, clearly marked.

Your rights

  • A 30-day cooling-off period from signing, with a full refund.
  • The right to transfer your plan to another funeral director if you move.
  • Instalment plans over up to 5 years, with the plan in force per its terms.
  • Your nominated family are told the plan exists and what it covers.

Pension treatment

A genuine prepaid funeral is generally exempt from the Services Australia assets test. Confirm your circumstances with Services Australia or a financial adviser — we cannot give financial advice.
